Terms and Conditions

WorkPe is a daily workforce management and attendance application designed for business owners, contractors, builders, and supervisors to maintain attendance logs and wage records with ease.

1. Introduction & Acceptance of Terms

These Terms and Conditions ("Terms" or "Agreement") constitute a legally binding agreement between you ("User", "you", or "your") and WorkPe Technologies Private Limited ("WorkPe", "we", "our", or "us"), governing your access to and usage of the WorkPe mobile application ("App"), our official website, and associated features (collectively, the "Service").

By downloading, registering, or continuing to use the Service, you confirm that you have read, understood, and agreed to be legally bound by these Terms and our Privacy Policy. If you do not accept these Terms in their entirety, you must immediately cease accessing or using WorkPe.

2. Description of Service & Operational Disclaimers

WorkPe provides digital productivity tools that enable contractors and businesses to record daily worker attendance (Present, Absent, Half-Day), log overtime (OT) hours, document advance payments, and generate periodic wage summary reports.

Non-Banking & Non-Settlement Declaration: WorkPe is strictly a software recording and productivity tool. WorkPe is not a bank, financial institution, payment system operator, or licensed payment aggregator. WorkPe does not hold, transmit, custody, or settle monetary funds between business owners and workers. All wage disbursements and settlements are negotiated and handled independently between you and your personnel.

WorkPe's automatic calculations are generated based solely upon the data, wage rates, and attendance marks input by you. WorkPe does not provide statutory payroll compliance, tax advisory, or legal labor consultancy.

3. Accounts, Security & Eligibility

3.1 Age Requirement: The Service is intended exclusively for business owners, supervisors, and employers aged 18 years or older who are legally competent to enter into binding agreements under the Indian Contract Act, 1872. Minors may use the Service only under the direct supervision of a parent or legal guardian.

3.2 Account Authentication: Registration requires your valid 10-digit Indian mobile number authenticated through a One-Time Password (OTP). You are solely responsible for maintaining the confidentiality of your mobile device and login sessions. You must report any suspected breach or unauthorized access immediately to support@workpe.app.

3.3 Employer Compliance Responsibility: As the employer or contractor, you retain full responsibility for complying with all applicable local, state, and central labor statutes, minimum wage mandates, PF/ESI regulations, and employment laws.

4. Device Permissions & Technical Capabilities

To deliver comprehensive attendance logging and reporting capabilities, the WorkPe App may request access to particular device functionalities:

  • Push Notifications: Required to deliver daily morning attendance reminders, subscription alerts, and critical system notices.
  • Worksite Location (Optional): Required only where geotagged worksite check-in features are utilized by supervisors.
  • Local Storage / Media Access: Necessary to save, view, and export monthly payroll registers and attendance cards in PDF or Excel formats.
  • Network Access: Required to synchronize local records with encrypted cloud servers when an internet connection is present.

Operational Disclaimer: App performance and reminder delivery may be influenced by your device settings, operating system versions, battery optimization restrictions, and network coverage.

5. Acceptable Use & Prohibited Conduct

You agree to use WorkPe only for lawful business purposes. You agree not to:

  • Decompile, reverse engineer, disassemble, or attempt to derive the source code of the WorkPe mobile application or associated APIs.
  • Deploy automated bots, spiders, crawlers, or scraping scripts to extract information from the Service.
  • Use the Service for fraudulent, deceptive, or unlawful workforce practices.
  • Sell, resell, rent, sublicense, or commercially distribute the App or Service to third parties without prior written authorization from WorkPe.
  • Introduce malicious software, viruses, trojans, or attempt unauthorized access to our cloud infrastructure or interconnected systems.
  • Impersonate another individual or business or misrepresent your affiliation with any entity.

6. User Content & Proprietary Ownership

6.1 Your Ownership: You retain complete ownership of all worker names, mobile numbers, attendance entries, notes, and wage records that you input into the Service ("User Content").

6.2 Limited Operating License: You grant WorkPe a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, adapt, process, and display your User Content strictly for the purpose of operating, maintaining, syncing, and delivering the Service and generating your requested reports.

6.3 Content Representations: You warrant that you have obtained all necessary lawful authorizations and consents from your workers or employees before entering their personal data into WorkPe.

7. Subscriptions, In-App Purchases & Billing

7.1 Free & Premium Features: WorkPe provides core daily workforce recording and attendance logging free of charge. Optional advanced capabilities (such as extended backup history, custom payroll registers, multi-supervisor access, and priority support) are offered via paid subscription plans.

7.2 Pricing Transparency: Subscription rates and billing terms are clearly disclosed within the App prior to completing any purchase.

7.3 In-App Billing: All digital subscriptions and purchases are processed directly through authorized app store platforms (e.g., Google Play In-App Billing) or designated payment gateway partners.

7.4 Auto-Renewal: Subscriptions renew automatically at the end of each billing cycle (monthly or annually) unless you cancel the auto-renewal at least 24 hours prior to the conclusion of the active subscription period via your app store account settings.

7.5 Refund Rules: All digital subscription purchases are non-refundable, and no partial or pro-rata refunds are provided, except as explicitly set forth in our Return & Refund Policy.

8. Termination & Suspension

8.1 Termination by You: You may stop using the Service or delete your account at any time via App Settings or by contacting WorkPe Support.

8.2 Suspension or Termination by Us: WorkPe reserves the right to suspend or terminate your account immediately, without prior notice, in the event of:

  • Any material breach or violation of these Terms or our Privacy Policy;
  • Fraudulent, unauthorized, or abusive usage of the application;
  • Failure to pay applicable subscription fees;
  • Compliance with mandatory directives issued by law enforcement or regulatory authorities.

9. Intellectual Property Rights

The WorkPe name, logo, software code, graphic designs, icons, user interface layout, documentation, and all underlying intellectual property belong exclusively to WorkPe Technologies Private Limited.

Subject to your compliance with these Terms, WorkPe grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use the App solely for your internal business workforce management.

10. Disclaimers & "As-Is" Warranty

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE INDIAN LAW, WORKPE EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER STATUTORY, EXPRESS, OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WORKPE DOES NOT GUARANTEE THAT THE APP WILL BE CONTINUOUSLY AVAILABLE, UNINTERRUPTED, COMPLETELY SECURE, OR FREE FROM ERRORS, BUGS, OR HARMFUL COMPONENTS, NOR DOES IT WARRANT THAT SAVED ESTIMATIONS WILL FULLY SATISFY SPECIFIC STATUTORY AUDIT CRITERIA.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WORKPE TECHNOLOGIES PRIVATE LIMITED, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES—INCLUDING LOSS OF PROFITS, DATA CORRUPTION, WORKPLACE DISPUTES, WAGE MISCALCULATIONS, OR BUSINESS INTERRUPTION—ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

NOTWITHSTANDING ANYTHING TO THE CONTRARY, THE TOTAL AGGREGATE LIABILITY OF WORKPE FOR ALL CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO WORKPE IN THE PRECEDING TWELVE (12) MONTHS, OR INR 1,000 (INDIAN RUPEES ONE THOUSAND), WHICHEVER IS GREATER.

12. Indemnification

You agree to defend, indemnify, and hold harmless WorkPe Technologies Private Limited, its directors, employees, and agents from and against all third-party claims, liabilities, losses, damages, fines, and legal expenses arising out of:

  • Your violation or breach of any provision of these Terms or applicable laws;
  • Your misuse of the Service or inaccurate recording of worker entries;
  • Any employment, wage, overtime, or labor disputes between you and your workers;
  • Any infringement or violation of third-party rights, including privacy rights.

13. Eligibility & Legal Representations

By using WorkPe, you represent and warrant that you possess the full legal power and capacity to enter into this Agreement, that you are not prohibited from receiving services under Indian laws, and that your use of the Service does not contravene any applicable commercial or statutory regulation.

14. Assignment

You may not assign, transfer, or delegate any rights or obligations under these Terms without our prior written consent. WorkPe may freely assign or transfer its rights and obligations under this Agreement in connection with a corporate merger, restructuring, acquisition, or asset transfer.

15. Governing Law & Dispute Resolution

These Terms shall be governed by, interpreted, and construed in accordance with the laws of the Republic of India. Any controversy, claim, or dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts situated in Bengaluru, Karnataka or Surat, Gujarat, India.

16. Return & Refund Policy Reference

All matters concerning in-app purchases, digital billing, auto-renewal cancellations, and refund evaluations are strictly governed by our dedicated Return & Refund Policy, which forms an integral part of these Terms.

17. Consent to Communications

You explicitly consent to receive operational communications, notifications, and alerts from WorkPe through SMS, WhatsApp, RCS, automated phone calls, in-app banners, and email. These notices pertain to transaction confirmations, security notices, attendance reminders, and customer support resolutions.

18. Modifications & Notices

WorkPe reserves the right to modify these Terms at any time. When updates occur, the revised document will be posted on this page with an updated "Effective Date". For substantial revisions, reasonable advance notice will be given through the App or website. Continued use of the Service after published updates signifies your binding acceptance.

19. Grievance Compliance & Transparency Report

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, WorkPe maintains a monthly transparency register regarding consumer grievances:
